This Liability Waiver and Release Agreement (“Agreement”) is entered into by and between Rock Shoe Revival (“Service Provider”) and the undersigned customer (“Customer”). By signing this Agreement, the Customer agrees to the following: 1. Assumption of Risk. I understand that climbing is an inherently dangerous activity and that proper equipment maintenance, including climbing shoes, is critical to my safety. I acknowledge that: Any modifications or repairs made to my climbing shoes by Rock Shoe Revival do not guarantee safety or performance. There are risks involved with using resoled or repaired climbing shoes, including the potential for sole delamination, unexpected wear, or performance changes. It is my responsibility to inspect all equipment, including my climbing shoes, before use. 2. Release of Liability. I hereby release, waive, and discharge Rock Shoe Revival, its owner(s), employees, contractors, and affiliates from any and all claims, liabilities, demands, actions, or causes of action arising out of or related to: Any damage to my climbing shoes or gear while in possession of Rock Shoe Revival. Any personal injury, death, or property damage sustained while using equipment serviced by Rock Shoe Revival, whether resulting from negligence or otherwise. 3. Limitation of Liability. Rock Shoe Revival’s liability for any reason shall be strictly limited to the cost of the services provided. Rock Shoe Revival makes no guarantees as to the outcome or performance of any repair or resole work. 4. Ownership & Abandoned Gear. I confirm that I am the rightful owner or authorized agent of the gear submitted for repair. I understand that if my shoes are not claimed within 90 days after notification of completed work, they may be considered abandoned and disposed of at the discretion of Rock Shoe Revival. 5. Photo Release. I give permission to Rock Shoe Revival to photograph my shoes for promotional use, including social media and website content. No personal identifying information will be shared without additional consent. I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, FULLY UNDERSTAND ITS TERMS, AND SIGN IT FREELY AND VOLUNTARILY.
